2011. novem­ber 18-án – az Álla­mi Szám­ve­vő­szék kez­de­mé­nye­zé­se alap­ján – a köz­igaz­ga­tá­si és igaz­ga­tás­ügyi minisz­ter, a leg­főbb ügyész, a Leg­fel­sőbb Bíró­ság elnö­ke és az Álla­mi Szám­ve­vő­szék elnö­ke közös nyi­lat­ko­za­tot írtak alá, amely­ben erköl­csi köte­le­zett­sé­get vál­lal­tak az álta­luk veze­tett álla­mi szer­vek kor­rup­ci­ó­val szem­be­ni ellen­ál­ló képes­sé­gé­nek erő­sí­té­sé­re, a kor­rup­ció­el­le­nes esz­köz­tár fej­lesz­té­sé­re. Az össze­fo­gás­hoz 2012-ben csat­la­ko­zott az Orszá­gos Bíró­sá­gi Hiva­tal, majd 2014-ben a Bel­ügy­mi­nisz­té­ri­um. 2016-ban – az együtt­mű­kö­dés ötö­dik évfor­du­ló­ján – egyet­ér­té­si szán­dé­kát feje­zi ki a Köz­be­szer­zé­si Ható­ság és a Magyar Nem­ze­ti Bank.

2016. novem­ber 17-én, öt évvel a közös nyi­lat­ko­zat alá­írá­sát köve­tő­en, Dr. Pin­tér Sán­dor bel­ügy­mi­nisz­ter, Domo­kos Lász­ló, az Álla­mi Szám­ve­vő­szék elnö­ke, Dr. Handó Tünde, az Orszá­gos Bíró­sá­gi Hiva­tal elnö­ke, Dr. Haj­nal Péter, a Kúria tanács­el­nö­ke és Dr. Laj­tár Ist­ván leg­főbb ügyész helyet­tes az Álla­mi Szám­ve­vő­szék szék­há­zá­ban érté­kel­ték az álta­luk veze­tett intéz­mény kor­rup­ció­el­le­nes tevé­keny­sé­gé­nek elmúlt öt évét, majd az ered­mé­nyek­ről tájé­koz­tat­ták a közvéleményt.

A Bel­ügy­mi­nisz­té­ri­um javas­la­ta alap­ján a Kor­mány 2015-ben elfo­gad­ta a Nem­ze­ti Kor­rup­ció­el­le­nes Prog­ra­mot, amely a 2015-2018 közöt­ti idő­szak kor­mány­za­ti kor­rup­ció­el­le­nes tevé­keny­sé­gé­nek leg­fon­to­sabb keret­do­ku­men­tu­ma. Az öt éve alá­írt Közös Nyi­lat­ko­zat szel­le­mi­sé­gé­vel össz­hang­ban a Prog­ram alap­ve­tő cél­ki­tű­zé­se a kor­rup­ció vissza­szo­rí­tá­sa, hazánk ver­seny­ké­pes­sé­gé­nek és nem­zet­kö­zi meg­íté­lé­sé­nek javí­tá­sa. E stra­té­gia elvi éllel meg­fo­gal­maz­za, hogy min­den olyan tár­sa­dal­mi jelen­ség, amely során vala­ki a rábí­zott hata­lom­mal magán- vagy cso­port­előny érde­ké­ben vissza­él, veszé­lyes az egész tár­sa­da­lom­ra. A stra­té­gi­ai doku­men­tum nem pusz­tán sza­bá­lyo­zá­si esz­kö­zök­kel törek­szik elér­ni a kitű­zött közös célo­kat, a gya­kor­la­ti meg­va­ló­sí­tást a Prog­ram vég­re­haj­tá­sát szol­gá­ló két év idő­tar­ta­mú intéz­ke­dé­si ter­vek biztosítják.

A Prog­ram elfo­ga­dá­sa­kor fel­kér­te a Kor­mány a Magyar Nem­ze­ti Ban­kot és a Köz­be­szer­zé­si Ható­sá­got, hogy működ­je­nek közre a korrupció-megelőzéssel kap­cso­la­tos fel­ada­tok vég­re­haj­tá­sá­ban, és saját stra­té­gi­á­juk meg­va­ló­sí­tá­sa során is kiemelt helyet kap­jon a kor­rup­ció meg­elő­zé­se. Így a két szer­ve­zet Közös Nyi­lat­ko­zat­hoz tör­té­nő csat­la­ko­zá­sa nem a kor­rup­ció elle­ni küz­de­lem­ben való együtt­mű­kö­dés kez­de­tét, hanem sok­kal inkább foly­ta­tá­sát, elmé­lyí­té­sét jelenti.

Az integ­rán­san műkö­dő szer­ve­ze­tek­ben kiemelt figyel­met kell for­dí­ta­ni az embe­ri ténye­ző­re, az olyan mun­ka­kö­rök­re, ame­lyek­ben az ott dol­go­zók foko­zot­tan ki van­nak téve a kor­rup­ci­ós veszé­lyek­nek. A Bel­ügy­mi­nisz­té­ri­um kor­rup­ció­el­le­nes tevé­keny­sé­gei közül kieme­len­dő az öt éve lét­re­ho­zott Nem­ze­ti Védel­mi Szol­gá­lat mun­ká­ja. A szer­ve­zet­tel kap­cso­la­tos elvá­rás az volt, hogy sza­kít­son a jog­előd klasszi­kus, kizá­ró­lag a tit­kos infor­má­ció­gyűj­té­sen ala­pu­ló, hagyo­má­nyos bűn­ül­dö­zé­si arcu­la­tá­val, és hoz­zon létre egy meg­úju­ló, a tár­sa­dal­mi jelen­sé­gek­re gyor­san rea­gá­ló, korunk igé­nye­i­nek meg­fe­le­lő szer­ve­ze­tet. A meg­bíz­ha­tó­sá­gi vizs­gá­lat és a kifo­gás­ta­lan élet­vi­tel ellen­őr­zés, mint új jog­in­téz­mé­nyek bevál­tot­ták a hoz­zá­juk főzött remé­nye­ket. A vizs­gá­la­tok­nak mára már pre­ven­tív hatá­sa is mutat­ko­zik. A Nem­ze­ti Védel­mi Szol­gá­lat elvé­gez­te az állam­igaz­ga­tá­si szer­vek köré­ben a mun­ka­kö­rök komp­lex kor­rup­ci­ós koc­ká­za­ta­i­nak fel­mé­ré­sét is, amely a szer­ve­ze­tek koc­ká­zat­elem­zé­se és koc­ká­zat­ke­ze­lé­se során lesz haté­ko­nyan felhasználható.

A köz­igaz­ga­tá­si rend­tar­tás­ról szóló tör­vény kon­cep­ci­ó­ja is tar­tal­maz­za azt az elvet, hogy a köz­igaz­ga­tás­nak ki kell zár­nia a kor­rup­ció min­den for­má­ját. Ha minél több ügy­tí­pus­ban tud az állam­pol­gár elekt­ro­ni­kus úton ügyet intéz­ni vagy a dön­tés auto­ma­ti­zá­lá­sa lehet­sé­ges, úgy a gyors, befo­lyás­tól men­tes, jog­sze­rű ügy­in­té­zés haté­ko­nyan biz­to­sít­ha­tó. E téren pél­da­ér­té­kű a már évek óta műkö­dő rend­őr­sé­gi rend­szer, amely egyes köz­le­ke­dé­si sza­bály­sze­gé­sek ese­tén auto­ma­ti­zált dön­tés­ho­za­talt való­sít meg az eljárásban.

A Bel­ügy­mi­nisz­té­ri­um üdvöz­li a Közös Nyi­lat­ko­zat­hoz csat­la­ko­zó Újabb szer­ve­ze­te­ket, bízva abban, hogy az együtt­mű­kö­dés során elkö­te­le­ző­dé­sük­kel, elszánt­sá­guk­kal új len­dü­le­tet adnak a kor­rup­ció elle­ni fel­ada­tok végrehajtásához.

Az Álla­mi Szám­ve­vő­szék (ÁSZ) az Ország­gyű­lés fel­ha­tal­ma­zá­sa alap­ján, az ÁSZ Stra­té­gi­á­já­ban fog­lal­tak­ra épít­ve elkö­te­lez­te magát az integ­ri­tás­ala­pú köz­igaz­ga­tá­si kul­tú­ra meg­ho­no­sí­tá­sa mel­lett és immár 10 éve for­dít kiemelt figyel­met a kor­rup­ció elle­ni küz­de­lem­re. Az Ország­gyű­lés az elmúlt évek­ben – 2007-ben, 2009-ben – több hatá­ro­za­tá­ban is meg­bíz­ta a Szám­ve­vő­szé­ket a kor­rup­ció elle­ni fel­lé­pés erő­sí­té­sé­vel, továb­bá az ÁSZ 2014. évi beszá­mo­ló­já­nak elfo­ga­dá­sá­ról hozott hatá­ro­za­tá­ban elis­mer­te és meg­erő­sí­tet­te a kor­rup­ci­ós koc­ká­za­tok fel­tér­ké­pe­zé­sé­re irá­nyu­ló, vala­mint az integ­ri­tás alapú szer­ve­ze­ti kul­tú­ra elter­jesz­té­se érde­ké­ben vég­zett munkáját.

Az Álla­mi Szám­ve­vő­szék a hol­land Szám­ve­vő­szék­kel való együtt­mű­kö­dés kere­té­ben meg­ala­po­zott, majd 2009-ben elin­dí­tott Integ­ri­tás pro­jekt révén, a kap­cso­ló­dó koc­ká­za­tok beazo­no­sí­tá­sá­val, a mód­szer­tan kidol­go­zá­sá­val, az integ­ri­tás tar­tal­mi ele­me­i­nek defi­ni­á­lá­sá­val egye­dül­ál­ló „magyar modellt” ala­kí­tott ki, alkal­mas­sá téve azt a magyar költ­ség­ve­té­si szfé­ra egé­szé­re tör­té­nő kiter­jesz­tés­re. Az ÁSZ integ­ri­tás fel­mé­résével 2016-ban már hato­dik alka­lom­mal mérte fel a magyar köz­szfé­ra kor­rup­ci­ós koc­ká­za­ta­it. Az idei adat­fel­vé­tel­ben min­den eddi­gi­nél több költ­ség­ve­té­si szerv vett részt, össze­sen 3002 szer­ve­zet regiszt­rált kitöl­tő­ként az ÁSZ infor­ma­ti­kai rend­sze­ré­ben. A csat­la­ko­zók száma több mint 400-al maga­sabb, mint az eddi­gi leg­na­gyobb rész­vé­tel­lel zaj­lott 2015. évi Integritás-felmérésben, amely­ben 2557 szer­ve­zet vett részt. Az idei kima­gas­ló rész­vé­tel­lel csak­nem meg­há­rom­szo­ro­zó­dott az első 2011-es fel­mé­rés­ben részt­ve­vők száma (1095 intézmény).

Az Álla­mi Szám­ve­vő­szék 2015 decem­be­ré­ben – egy vonat­ko­zó kor­mány­ha­tá­ro­zat irány­mu­ta­tá­sa alap­ján – kiter­jesz­tet­te a kor­rup­ci­ós koc­ká­za­to­kat és védett­sé­get fel­tér­ké­pe­ző integ­ri­tás fel­mé­ré­sét a több­sé­gi álla­mi tulaj­do­nú tár­sa­sá­gokra is. Az ÁSZ első alka­lom­mal elvég­zett, gaz­da­sá­gi tár­sa­sá­go­kat érin­tő integ­ri­tá­si fel­mé­ré­se kere­té­ben 252 tár­sa­ság kül­dött be érté­kel­he­tő kér­dő­ívet. A vála­szok alap­ján össze­fog­la­ló elem­zés készült, ame­lyet a Szám­ve­vő­szék 2016 máju­sá­ban egy „jó gya­kor­la­tok” sze­mi­ná­ri­um­mal egy­be­köt­ve hozott nyil­vá­nos­ság­ra. 2016 szep­tem­be­ré­ben az ÁSZ – a Megyei Jogú Váro­sok Szö­vet­sé­gé­vel lefoly­ta­tott szak­mai kon­zul­tá­ció alap­ján – az önkor­mány­za­ti gaz­da­sá­gi tár­sa­sá­gok­ra is kiter­jesz­tet­te integ­ri­tás fel­mé­ré­sét, így hama­ro­san az önkor­mány­za­ti gaz­da­sá­gi tár­sa­sá­gok kor­rup­ci­ós koc­ká­za­ta­i­ról, és az azo­kat mér­sék­lő kiépí­tett kont­rol­lok hely­ze­té­ről is képet alkothat.

Az elmúlt esz­ten­dők – és a vonat­ko­zó ország­gyű­lé­si hatá­ro­za­tok – leg­főbb ered­mé­nye az integ­ri­tás kul­tú­ra és az integ­ri­tás­köz­pon­tú gon­dol­ko­dás elter­je­dé­se. Ennek bizo­nyí­té­ka, hogy évről évre emel­ke­dik az Integ­ri­tás Támo­ga­tók Köre, már közel két­ezer szer­ve­zet vál­lal­ta, hogy 2017-ig min­den évben részt vesz az Álla­mi Szám­ve­vő­szék kor­rup­ció­el­le­nes fel­mé­ré­sé­ben, így biz­to­sít­va az éven­kén­ti össze­ha­son­lít­ha­tó­sá­got. Az egyre inkább elter­jedt integ­ri­tás­köz­pon­tú gon­dol­ko­dás lehe­tő­vé teszi, hogy az Álla­mi Szám­ve­vő­szék az integ­ri­tás terü­le­tén ezen­túl a mélyí­tés­re és az ellen­őr­zés­re helyez­ze a hang­súlyt. Ennek érde­ké­ben már 2015-től a kor­rup­ció elle­ni küz­de­lem része­ként min­den ellen­őr­zés­ben – ahol ezt jog­sza­bály lehe­tő­vé teszi – meg­je­le­nik az integ­ri­tás­el­vű műkö­dés érvé­nye­sí­té­sé­nek érté­ke­lé­se.

Az ÁSZ az integ­ri­tás szem­lé­let­vál­tás „motor­ja­ként”, annak meg­va­ló­sí­tá­sá­ban új esz­köz­ként 2014 óta öntesz­tek­kel is támo­gat­ja a köz­szfé­ra intéz­mé­nye­it. Az önkén­tes önteszt rend­szer alkal­ma­zá­sá­val javul­hat a kitöl­tő szer­ve­ze­tek belső kont­roll­rend­sze­re, önel­len­őr­zé­si képes­sé­ge, vagy­is elő­se­gít­he­tő a szer­ve­ze­ti integ­ri­tás alap­ja­i­nak meg­te­rem­té­se. Fon­tos ered­mény­nek és tevé­keny­sé­günk hasz­no­su­lá­sá­nak tart­juk, hogy a kor­rup­ció elle­ni kor­mány­za­ti intéz­ke­dé­sek­ről és a Köz­igaz­ga­tás Korrupció-megelőzési Prog­ram­já­nak elfo­ga­dá­sá­ról szóló 1104/2012. (IV. 6.) Korm. hatá­ro­zat, vala­mint a Nem­ze­ti Kor­rup­ció­el­le­nes Prog­ram­ban fog­lalt intéz­ke­dé­sek vég­re­haj­tá­sá­ra vonat­ko­zó 1336/2015. (V.27.) Korm. hatá­ro­zat figye­lem­be vette az Álla­mi Szám­ve­vő­szék gya­kor­la­tát, és a köz­szfé­ra integ­ri­tá­sá­nak erő­sí­té­sét helyez­te a prog­ram középpontjába.

Az Ország­gyű­lés 41/2013. (V. 27.) OGY hatá­ro­za­tá­val támo­gat­ta, hogy az ÁSZ részt vegyen a leg­főbb ellen­őr­ző intéz­mé­nyek nem­zet­kö­zi szak­mai szer­ve­ze­te (INTOSAI) Fej­lesz­té­si Kez­de­mé­nye­zé­sé­nek (IDI) tevé­keny­sé­gé­ben, és ahhoz donor­ként szak­mai támo­ga­tást nyújt­son, kiemelt figye­lem­mel a magyar kül­gaz­da­sá­gi stra­té­gi­á­ra. Az ÁSZ 2015 végén java­sol­ta, hogy a Nem­zet­gaz­da­sá­gi Minisz­té­ri­um kez­de­mé­nyez­ze az ÁSZ 2014. évi költ­ség­ve­té­si marad­vá­nyá­nak mint­egy 129 mil­lió forin­tos átcso­por­to­sí­tá­sát a Kül­gaz­da­sá­gi és Kül­ügy­mi­nisz­té­ri­um nem­zet­kö­zi szer­ve­ze­te­ket támo­ga­tó feje­ze­te szá­má­ra. Magyar­or­szág Kor­má­nya ezután – össz­hang­ban a 2013-as ország­gyű­lé­si hatá­ro­zat­tal - szin­tén hatá­ro­za­tá­val tette lehe­tő­vé az összeg IDI dono­ri prog­ram­jai szá­má­ra tör­té­nő fel­aján­lá­sát, ezzel Magyar­or­szág az IDI kor­rup­ció­el­le­nes prog­ram­ja­i­nak jelen­tős támo­ga­tó­já­vá lépett elő.

Az Álla­mi Szám­ve­vő­szé­ke aktív sze­rep­lő­je a szám­ve­vő­szé­kek nem­zet­kö­zi közös­sé­gé­nek, folya­ma­to­san meg­oszt­ja és hasz­no­sít­ja a meg­is­mert leg­jobb gya­kor­la­to­kat. E cél meg­va­ló­sí­tá­sát szol­gál­ja az ÁSZ nem­zet­kö­zi „jó gya­kor­la­tok” szeminárium-sorozata, mely­nek kere­té­ben a Szám­ve­vő­szék 2014. és 2015. után 2016 tava­szán har­mad­szor is meg­szer­vez­te – és a ter­vek sze­rint 2017-ben is meg­szer­ve­zi – az immár hagyo­má­nyos­nak szá­mí­tó négy­na­pos, szar­va­si nem­zet­kö­zi integ­ri­tás „jó gya­kor­la­tok” sze­mi­ná­ri­u­mát. Az eddi­gi három ese­mé­nyen össze­sen mint­egy 40 ország 90 szám­ve­vő­szé­ki szak­ér­tő­jé­vel osz­tot­tuk meg a kor­rup­ció elle­ni küz­de­lem terén szer­zett tapasztalatainkat.

A köz­szfé­ra integ­ri­tás szem­lé­le­té­nek fej­lő­dé­sét és a kor­rup­ció elle­ni nem­ze­ti össze­fo­gást mutat­ja, hogy az integ­ri­tás irá­nyí­tá­si rend­sze­rek­kel kap­cso­la­tos isme­re­tek és tapasz­ta­la­tok beépül­tek, beépül­nek a köz­szol­gá­la­ti szak­em­be­rek és veze­tők kép­zé­sé­be is. Az ÁSZ a Köz­igaz­ga­tá­si és Igaz­ság­ügyi Minisz­té­ri­um, vala­mint a Nem­ze­ti Köz­szol­gá­la­ti Egye­tem együtt­mű­kö­dé­sé­vel 2013-ban elin­dí­tott integ­ri­tás tanács­adó kép­zé­sen az elmúlt évek­ben 120 szak­ér­tő szer­zett dip­lo­mát. A tanács­adók a kor­rup­ció és vissza­élé­sek koc­ká­za­tá­nak csök­ken­té­sén keresz­tül támo­gat­ják a köz­igaz­ga­tás fej­lesz­té­sét. A kép­zés fővéd­nö­ke az Álla­mi Szám­ve­vő­szék elnö­ke. Az Ország­gyű­lés rész­ben az e téren elért ered­mé­nye­ket elis­mer­ve 34/2015. (VII. 7.) számú hatá­ro­za­tá­ban támo­gat­ta, hogy a köz­pén­zek­kel és köz­va­gyon­nal való gaz­dál­ko­dás­ban érin­tett szer­ve­ze­tek tekin­te­té­ben az ÁSZ szé­le­sít­se a veze­tői rend­sze­rek­re vonat­ko­zó tanács­adó tevé­keny­sé­gét és támo­gas­sa az eti­kus köz­pénz­ügyi vezető-képzést.

Az Álla­mi Szám­ve­vő­szék a kor­rup­ció meg­elő­zé­sé­nek mód­szer­ta­nát, méré­sét és ered­mé­nye­it külön­bö­ző szak­mai, tudo­má­nyos és okta­tá­si fóru­mo­kon meg­oszt­ja. Célunk, hogy szi­go­rú nem­zet­kö­zi stan­dar­dok alap­ján vég­zett kuta­tá­si és ellen­őr­zé­si mód­sze­re­ink és ered­mé­nye­ink egy­faj­ta refe­ren­cia­pont­ként szol­gál­ja­nak, ezál­tal hoz­zá­já­rul­ja­nak az integ­ri­tás szem­lé­let szé­les körű elterjedéséhez.

A 2011. novem­ber 18-án alá­írt, a kor­rup­ci­ó­val szem­be­ni ellen­ál­ló képes­ség erő­sí­té­sé­re vonat­ko­zó együtt­mű­kö­dé­si nyi­lat­ko­zat­ban fog­lal­tak tel­je­sü­lé­sét érté­kel­ve, a Kúria az elmúlt évben is több lépést tett az integ­ri­tás fej­lesz­té­se érdekében.

Figye­lem­mel arra, hogy az integ­ri­tás nem csu­pán a vesz­te­ge­té­si bűn­cse­lek­mé­nyek, hanem az álla­mi szerv műkö­dé­sét, jog­sza­bály­ban fog­lalt fel­ada­ta­i­nak ellá­tá­sát veszé­lyez­te­tő bár­mi­ne­mű anya­gi vagy erköl­csi vesz­te­ség meg­elő­zé­sé­re irá­nyul, a Kúria kiemelt fon­tos­sá­got tulaj­do­nít a belső sza­bály­za­tok rend­sze­res felül­vizs­gá­la­tá­nak. 2016-ban több okból is módo­sult a Szer­ve­ze­ti és Műkö­dé­si Sza­bály­zat. A sze­mély­ze­ti és okta­tá­si ügyek­kel fog­la­ko­zó osz­tály Koor­di­ná­ci­ós, Sze­mély­ze­ti és Okta­tá­si Főosz­tállyá ala­kult, ennek meg­fe­le­lő­en a módo­sí­tott sza­bály­zat meg­ha­tá­roz­za a koor­di­ná­ci­ós fel­ada­to­kat. A tör­vénnyel össz­hang­ban a sza­bály­zat neve­sí­ti az elekt­ro­ni­kus infor­má­ció­rend­szer biz­ton­sá­gi fele­lős pozí­ci­ó­ját és fel­ada­ta­it. A módo­sí­tott SZMSZ rög­zí­ti, hogy a Kúria kép­vi­se­le­tét a Kúri­á­val szol­gá­la­ti viszony­ban álló bíró látja el. A sza­bály­zat pon­to­sít­ja az igaz­ság­ügyi alkal­ma­zot­ti jog­vi­szony­ban állók vagyonnyilatkozat-tételi köte­le­zett­sé­ge­it is. 2016-ban lépett hatály­ba a Kúri­ai hatá­ro­za­tok szer­kesz­té­sé­ről szóló elnö­ki uta­sí­tás.

A Kúria kép­vi­se­lői útján az elmúlt évben is részt vett az OBH Integ­ri­tás Mun­ka­cso­port­já­ban, amely­nek köz­re­mű­kö­dé­sé­vel elké­szült az OBH elnö­ke által kiadott Integ­ri­tás Sza­bály­zat. A Sza­bály­zat ren­del­ke­zé­sé­vel össz­hang­ban a Kúria meg­al­kot­ta a saját integ­ri­tá­si sza­bály­za­tát, amely a bírák­ra és az igaz­ság­ügyi alkal­ma­zot­tak­ra egy­aránt kiter­jed, és rög­zí­ti az egyes aján­dé­kok elfo­ga­dá­sá­nak tilal­má­ra, az aján­dé­ko­zás sza­bá­lya­i­ra, az integritás-felelős fel­ada­ta­i­ra és az integ­ri­tás­sal kap­cso­la­tos beje­len­té­sek keze­lé­sé­re vonat­ko­zó szabályokat.

Az elmúlt egy évben a Kúria továb­bi intéz­ke­dé­se­ket tett az infor­ma­ti­kai rend­szer biz­ton­sá­gá­nak fej­lesz­té­se érde­ké­ben.  A lefoly­ta­tott sérü­lé­keny­ség vizs­gá­la­tok alap­ján meg­tör­tént a kri­ti­kus szer­ve­rek ope­rá­ci­ós rend­sze­ré­nek gyár­tó által támo­ga­tott ver­zi­ó­ra tör­té­nő cse­ré­je. A Kúria elekt­ro­ni­kus infor­má­ció­biz­ton­sá­gi fele­lő­se angol nyel­vű e-learning kép­zés után tett sike­res vizs­gát, és sze­rez­te meg az ún. Cer­ti­fi­ed Infor­ma­ti­on Secu­rity Mana­ger (CISM) tanú­sít­ványt, amellyel a jog­sza­bály­ban írt kép­zé­si köte­le­zett­sé­gé­nek is ele­get tett.

Az infor­má­ció­biz­ton­ság mel­lett a minő­sí­tett ada­tok védel­mé­re is külö­nös figyel­met for­dí­tott a Kúria. A Kúria előtt folyó rend­kí­vü­li per­or­vos­la­ti eljá­rá­sok­ban bizo­nyí­tás­nak helye nincs, így a Kúria részé­ről nem tör­té­nik minő­sí­tés, ugyan­ak­kor az alsóbb szin­tű bíró­sá­gok­ról rend­sze­re­sen érkez­nek minő­sí­tett ada­to­kat tar­tal­ma­zó ira­tok, melyek szak­sze­rű és a jog­sza­bá­lyi köve­tel­mé­nyek­nek meg­fe­le­lő őrzé­sé­ről a Kúria gon­dos­ko­dik. Az elekt­ro­ni­ku­san kezelt minő­sí­tett ada­tok biz­ton­sá­gát szol­gál­ja a 2016-ban az Orszá­gos Bíró­sá­gi Hiva­tal által kiírt pályá­zat ered­mé­nye­ként elnyert ún. TEMPEST minő­sí­té­sű lap­top, amellyel a tit­kos ügy­ke­ze­lő (TÜK) iro­dát sze­rel­tük fel. A tech­no­ló­gia lénye­ge a minő­sí­tett ada­tot tar­tal­ma­zó esz­köz elekt­ro­mág­ne­ses kisu­gár­zá­sá­nak mini­má­lis szint­re való csök­ken­té­se, ami meg­aka­dá­lyoz­za az ille­ték­te­len hoz­zá­fé­rést. A vonat­ko­zó jog­sza­bá­lyok­nak meg­fe­le­lő­en a Nem­ze­ti Biz­ton­sá­gi Fel­ügye­let végez­te el az esz­köz minő­sí­té­sét, amely alap­ján a Kúria a vonat­ko­zó műkö­dé­si enge­délyt megkapta.

A kor­rup­ci­ó­nak ellen­ál­ló szer­ve­ze­ti kul­tú­ra meg­te­rem­té­se érde­ké­ben az elmúlt évben az Alkot­mány­vé­del­mi Hiva­tal köz­re­mű­kö­dé­sé­vel tudás­meg­osz­tó kon­fe­ren­ci­á­kat tar­tott, melyen kiemelt sze­re­pet kapott a kor­rup­ció meg­elő­zé­se és a biz­ton­ság­tu­da­tos­ság erősítése.

A minél szé­le­sebb körű és minél maga­sabb szin­tű integ­ri­tás eléré­se elkép­zel­he­tet­len az együtt­mű­kö­dés nél­kül, ezért a Kúria 2016-ban is – immár ötö­dik alka­lom­mal – részt vett az ÁSZ Integ­ri­tás Pro­jekt kere­té­ben vég­zett kor­rup­ció­el­le­nes fel­mé­rés­ben és – hét másik intéz­ménnyel együtt – „kivá­ló” minő­sí­tést kapott.

A bíró­sá­gok integ­ri­tá­sát biz­to­sí­tó szer­ve­ze­ti, műkö­dé­si rend­szer kiala­kí­tá­sát az Orszá­gos Bíró­sá­gi Hiva­tal (OBH) elnö­ke a kez­de­tek­től fogva kiemelt fel­ada­tá­nak tekin­ti. Szem előtt tart­ja azt a 2011-ben alá­írt közös nyi­lat­ko­zat­ban fog­lalt köte­le­zett­ség­vál­la­lást, amely a kor­rup­ció elle­ni haté­kony fel­lé­pés fon­tos­sá­gát hang­sú­lyoz­ta. Elkö­te­le­zett­sé­ge abban is tük­rö­ző­dik, hogy 2012 óta a kiemelt stra­té­gi­ai cél­jai között sze­re­pel a bíró­sá­gi szer­ve­zet integ­ri­tá­sa, az ítél­ke­zé­si és igaz­ga­tá­si munka átlát­ha­tó­sá­ga, utób­bi kiszá­mít­ha­tó­sá­ga és ellenőrzöttsége.

Az OBH 2012-ben az Alkot­mány­vé­del­mi Hiva­tal­lal együtt­mű­köd­ve elin­dí­tot­ta a biz­ton­ság­tu­da­tot fókusz­ba helye­ző ún. „Aware­ness Prog­ra­mot”. A kép­zé­se­ket tartó szak­em­be­rek szem­lé­le­te­sen mutat­ják be a bírá­kat és igaz­ság­ügyi alkal­ma­zot­ta­kat érin­tő biz­ton­sá­gi kérdéseket.

Szin­tén 2012-től kezd­ve műkö­dik az OBH Bíró­sá­gi Integ­ri­tás Mun­ka­cso­port­ja. E mun­ka­cso­port tag­jai külön­bö­ző bíró­sá­go­kon, külön­bö­ző ügy­sza­kok­ban tevé­keny­ke­dő veze­tők, bírák, nagy tapasz­ta­la­tú elmé­le­ti és gya­kor­la­ti szak­em­be­rek. Meg­vi­tat­ják a leg­fon­to­sabb, integ­ri­tást érin­tő szak­mai kér­dé­se­ket és kidol­goz­zák az ezek­kel kap­cso­la­tos igaz­ga­tá­si intéz­ke­dé­si javas­la­to­kat. E mel­lett az Orszá­gos Bírói Tanács kez­det­ben meg­fi­gye­lő­ként, majd 2015-től tel­jes jogú tag­ként vesz részt az Igaz­ság­szol­gál­ta­tá­si Taná­csok Euró­pai Háló­za­tá­nak (ENCJ) szak­mai mun­ká­já­ban, ahol a bírói füg­get­len­ség és etika euró­pai nor­má­i­val szer­ve­ze­ti szin­ten foglalkoznak.

A bíró­sá­gok tovább­ra is min­den évben részt vesz­nek az Álla­mi Szám­ve­vő­szék integ­ri­tás fel­mé­ré­sében.

Kiemel­ke­dő lépés volt a bíró­sá­gi szer­ve­zet integ­ri­tá­sá­nak tel­je­seb­bé téte­le felé veze­tő úton, a bírák Eti­kai Kóde­xé­nek 2015. janu­ár 1-jei hatály­ba lépé­se.  A kódex a „Bangalore-i Elvek” alap­ján fogal­maz meg morá­lis elvá­rá­so­kat a bírák­kal szem­ben a füg­get­len­ség, az össze­fér­he­tet­len­ség, a mél­tó­ság, a gon­dos­ság, a tisz­tes­ség, a tisz­te­let és az együtt­mű­kö­dés elvei köré cso­por­to­sít­va őket.

2015 novem­be­ré­ben a bírák által kitöl­tött integ­ri­tás kér­dő­íven keresz­tül fel­mér­tük a bíró­sá­gok integ­ri­tá­si hely­ze­tét, a bírák tuda­tos­sá­gát az integ­ri­tást sértő és veszé­lyez­te­tő hely­ze­tek elke­rü­lé­sé­ben. A kér­dő­ív tapasz­ta­la­ta­it fel­hasz­nál­va, a leg­ér­zé­ke­nyebb terü­le­tek­re fókusz­ál­va dol­goz­tuk ki az Integ­ri­tá­si Sza­bály­zat tervezetét.

2016. janu­ár 1-jén hatály­ba lépett a bíró­sá­gok igaz­ga­tá­sá­ról szóló sza­bály­zat, amely az igaz­ga­tá­si tevé­keny­ség sza­bá­lyo­zá­sán keresz­tül biz­to­sít­ja az igaz­ga­tá­si munka átlát­ha­tó­sá­gát, kiszá­mít­ha­tó­sá­gát és ellen­őriz­he­tő­sé­gét. 2016 janu­ár­já­ban elké­szült a bíró­sá­gi szer­ve­zet integ­ri­tás tér­ké­pe és ugyan­eb­ben a hónap­ban az együtt­mű­kö­dés­ben részt­ve­vő szer­vek bevo­ná­sá­val integ­ri­tás kon­fe­ren­ci­át ren­dez­tünk. A részt­ve­vők elő­adá­so­kat hall­hat­tak az igaz­ság­szol­gál­ta­tá­si tevékenység
– ezen belül - a bíró­ság integ­ri­tá­si veszé­lyez­te­tett­sé­gé­ről, a lehet­sé­ges veszély­hely­ze­tek­ről, illet­ve azok keze­lé­sé­nek gya­kor­la­ti tapasztalatairól.

2016. júli­us 1-jén hatály­ba lépett az Integ­ri­tá­si Sza­bály­zat, mely­nek célja a bíró­sá­gi szer­ve­zet integ­ri­tá­sá­nak biz­to­sí­tá­sa, vala­mint az átlát­ha­tó­ság, a fele­lős­ség, a pár­tat­lan­ság és a tisz­tes­sé­ges eljá­rás, illet­ve az integ­ri­tást sértő maga­tar­tá­sok­kal szem­be­ni egy­sé­ges és ará­nyos fel­lé­pés garan­tá­lá­sa. A sza­bály­zat egyik kéz­zel­fog­ha­tó ered­mé­nye, hogy az OBH-nak, vala­mennyi íté­lő­táb­lá­nak és tör­vény­szék­nek van kije­lölt integ­ri­tás­fe­le­lő­se, akik fel­ada­ta a többi között a bíró­sá­gi szer­ve­zet integ­ri­tá­sát érin­tő beje­len­té­sek­nek a foga­dá­sa, gyűj­té­se, elem­zé­se, érté­ke­lé­se, a keze­lé­sük­höz szük­sé­ges veze­tői intéz­ke­dé­sek meg­ho­za­ta­lá­nak elősegítése.

Még az idén néhány kér­dés­sel kiegé­szít­ve ismé­tel­ten kiad­juk a bírák integ­ri­tás kér­dő­ívét, annak fel­mé­ré­se érde­ké­ben, hogy az eddi­gi erő­fe­szí­té­se­ink milyen ered­mény­re vezet­tek, illet­ve mely terü­le­te­ken van szük­ség továb­bi intéz­ke­dé­sek­re. Mind­ezek mel­lett folya­mat­ban van egy orszá­go­san egy­sé­ges ügy­el­osz­tá­si rend, sab­lon kidol­go­zá­sa is.

Magyar­or­szág Ügyész­sé­ge az elmúlt öt évben jelen­tős ered­mé­nye­ket ért el mind a kor­rup­ci­ós bűn­cse­lek­mé­nyek elle­ni küz­de­lem, mind pedig a szer­ve­ze­ti integ­rá­ció terén. A kor­rup­ció elle­ni haté­kony fel­lé­pés alap­ve­tő fel­té­te­le a külső és a belső együttműködés.

Az ügyész­ség az elmúlt idő­szak­ban jelen­tő­sen erő­sí­tet­te a nem­zet­kö­zi kap­cso­la­tai külön­bö­ző szint­je­it. Ezek közül külön kieme­lést érde­mel az USA-val tör­té­nő jog­se­gély­for­ga­lom, amely – több egyez­te­tés ered­mé­nye­ként – vár­ha­tó­an zökkenő-mentesebbé válik a jövő­ben. Kife­je­zet­ten ked­ve­ző a Leg­főbb Ügyész­ség Euró­pai Csa­lás Elle­ni Hiva­tal­lal való kap­cso­la­ta. Dr. Polt Péter leg­főbb ügyész és dr. Gio­van­ni Kess­ler, az OLAF főigaz­ga­tó­ja tava­lyi talál­ko­zó­ját köve­tő­en, több szak­ér­tői szin­tű egyez­te­tés­re, infor­má­ció­cse­ré­re került sor.

Az ügyész­ség és a rend­őr­ség – társ­ha­tó­sá­gok­kal közös – ered­mé­nyes mun­ká­já­nak köszön­he­tő­en, az elmúlt öt évben – az azt meg­elő­ző idő­szak­hoz képest – lénye­ge­sen több kor­rup­ci­ós cse­lek­ményt sike­rült fel­tár­ni (2006-2010 között össze­sen 2.818, míg 2011-2015 között össze­sen 6702).

A kor­rup­ció elle­ni ered­mé­nye­sebb fel­lé­pés cél­já­val 2011. ápri­li­sá­ban a Köz­pon­ti Nyo­mo­zó Főügyész­sé­gen fel­ál­lí­tott Kor­rup­ció Elle­ni Ügyek Osz­tá­lya a főügyész­ség hatás­kö­ré­be tar­to­zó hiva­ta­los sze­mé­lyek által soro­za­tos, illet­ve szer­ve­zett módon, vala­mint kor­rup­ci­ós jel­leg­gel elkö­ve­tett bűn­cse­lek­mé­nyek ügyé­ben jár el. A Köz­pon­ti Nyo­mo­zó Főügyész­ség­re az integ­rá­ci­ós együtt­mű­kö­dés elmúlt öt évé­ben (2011. novem­be­ré­től 2016. szep­tem­be­ré­ig) 822 kor­rup­ci­ós bűn­cse­lek­mény miatt tett fel­je­len­tés érke­zett, 732 nyo­mo­zás indult, amely­ből mos­ta­ná­ig 201 ügy­ben emel­tek vádat, 578 vád­lot­tal szem­ben. Eddig 86 ügy­ben 138 vád­lot­tat ítél­tek el a bíró­sá­gok. Szá­mos nyo­mo­zás, illet­ve bíró­sá­gi eljá­rás jelen­leg is folya­mat­ban van. Az eljá­rás alá vont ter­hel­tek között men­tel­mi jog­gal ren­del­ke­ző sze­mé­lyek épp­úgy vol­tak, mint pol­gár­mes­te­rek, veze­tő beosz­tá­sú rend­őrök, illet­ve adó­ha­tó­sá­gi és más tisztviselők.

A kor­rup­ció elle­ni ered­mé­nye­sebb fel­lé­pést szol­gál­ták a Leg­főbb Ügyész­ség elmúlt évi vizs­gá­la­tai, ame­lyek a bűn­el­kö­ve­té­si forma jel­lem­ző­it, illet­ve a vagyon­el­kob­zás kér­dé­sét ele­mez­ték. A Leg­főbb Ügyész­ség a tapasz­ta­la­ta­it – a fel­tárt hibák jövő­be­li elke­rü­lé­se érde­ké­ben – irány­mu­ta­tás for­má­já­ban a főügyész­sé­gek­kel is megosztotta.

A Leg­főbb Ügyész­sé­gen 2016. janu­ár 1-tól fel­ál­lí­tott új köz­pon­ti főosz­tály – a Kiemelt, Kor­rup­ci­ós és Szer­ve­zett Bűnö­zés Elle­ni Ügyek Főosz­tá­lya – biz­to­sít­ja a kor­rup­ci­ós bűn­cse­lek­mé­nyek elle­ni fel­lé­pés még ered­mé­nye­sebb szak­mai irányítását.

A Leg­főbb Ügyész­ség – a kor­rup­ció elle­ni harc tapasz­ta­la­ta­it fel­hasz­nál­va – kifej­tet­te érve­it az új bün­te­tő­el­já­rá­si tör­vény kodi­fi­ká­ci­ó­ja során. Az ügyész­ség egyet­ér­tett azzal, hogy a ter­ve­zett sza­bá­lyo­zás a men­tes­ség körét szű­kí­ti. Fon­tos ered­mény, hogy az ügyész­ség köz­re­mű­kö­dé­sé­vel meg­je­le­nik a ter­ve­zet­ben a spe­ci­á­lis nyo­mo­za­ti tech­ni­kák sza­bá­lyo­zá­sa. A külön­bö­ző lep­le­zett esz­kö­zök alkal­ma­zá­sa a kor­rup­ció fel­de­rí­té­sé­nek és bizo­nyí­tá­sá­nak elen­ged­he­tet­len feltétele.

A Nem­ze­ti Védel­mi Szol­gá­lat által vég­zett meg­bíz­ha­tó­sá­gi vizs­gá­lat lefoly­ta­tá­sá­ra ügyé­szi jóvá­ha­gyást köve­tő­en kerül­het sor, majd a vizs­gá­lat befe­je­zé­sét köve­tő­en az ügyész a vég­re­haj­tás tör­vé­nyes­sé­gét is ellen­őr­zi. E fel­ada­to­kat az ügyé­szi szer­ve­zet­ben a köz­jo­gi szak­ág látja el. Idén növe­ke­dett a szű­ré­sek haté­kony­sá­ga, mivel – a csök­ke­nő számú vizs­gá­lat elle­né­re – a bün­te­tő fel­je­len­tést ered­mé­nye­ző integ­ri­tás ügyek száma már októ­ber­re meg­kö­ze­lí­tet­te az előző évi ada­to­kat (2015: 26, 2016. októ­be­ré­ig: 23). Az elmúlt idő­szak­ban a Leg­főbb Ügyész­ség bün­te­tő­jo­gi szak­te­rü­le­te is össze­gez­te a meg­bíz­ha­tó­sá­gi vizs­gá­la­tok nyo­mán indult bün­te­tő­ügyek tapasz­ta­la­ta­it. A leg­fon­to­sabb meg­ál­la­pí­tás: ez idáig egyet­len ilyen ügy­ben sem szü­le­tett fel­men­tő ítélet.

Az integ­ri­tás meg­te­rem­té­sé­nek alap­ve­tő fel­té­te­le a sze­mé­lyi és szer­ve­ze­ti biz­ton­ság. A kér­dés külö­nös súllyal merül fel a 2016. már­ci­u­sá­ban a Kis­kun­ha­la­si Járá­si Bíró­ság és Ügyész­ség épü­le­té­ben tör­tént gép­ka­ra­bé­lyos táma­dás fényé­ben. Az új biz­ton­sá­gi koc­ká­za­tok a véde­lem továb­bi növe­lé­sét indo­kol­ják. 2016. ápri­li­sá­ban Dr. Polt Péter leg­főbb ügyész és Dr. Pin­tér Sán­dor bel­ügy­mi­nisz­ter közös ügyészségi-rendőrségi együtt­mű­kö­désről dön­tött az ügyész­sé­gi sze­mé­lyi állo­mány, épü­le­tek és adat­va­gyon biz­ton­sá­gá­nak és védel­mé­nek foko­zá­sa érde­ké­ben. Az együtt­mű­kö­dés kere­té­ben egy tech­ni­kai mun­ka­cso­port fel­mér­te az ügyé­szi szer­vek elhe­lye­zé­sé­re szol­gá­ló épü­le­tek biz­ton­ság­tech­ni­kai ele­me­it, ille­tő­leg javas­la­tot tett egy orszá­gos ügyész­sé­gi tele­fo­nos vész­jel­ző rend­szer kiépí­té­sé­re. A 2016 augusz­tu­sá­ban vég­re­haj­tott sike­res teszt­üze­met köve­tő­en, az orszá­gos háló­zat a követ­ke­ző év első negyed­évé­től kezdi meg a működését.

Mind­eze­ken túl, a szer­ve­ze­ti integ­ri­tást a kor­rup­ci­ós koc­ká­za­tok vizs­gá­la­ta, a folya­ma­tos és szé­les körű kép­zés épp­úgy erő­sí­ti, mint a 2014. decem­be­ré­ben elfo­ga­dott Ügyész­sé­gi Eti­kai Kódex, továb­bá a kor­rup­ci­ós ügyek­ben tett intéz­ke­dé­sek – a szer­ve­zet hon­lap­ján és a médi­án keresz­tül tör­té­nő – rend­sze­res bemutatása.

On 18 Novem­ber 2011, upon the ini­ti­a­tive of the State Audit Offi­ce of Hun­gary, the Minis­ter of Pub­lic Admi­nistra­ti­on and Jus­ti­ce, the Pro­se­cu­tor Gene­ral of Hun­gary, the Pres­ident of the Sup­re­me Court of Hun­gary and the Pres­ident of the State Audit Offi­ce of Hun­gary sign­ed a joint dec­la­ra­ti­on, in which they assum­ed moral obli­ga­ti­on for strengt­he­ning resili­en­ce aga­inst cor­rupt­ion and for imp­ro­ving the anti-corruption met­hods app­li­ed by the pub­lic bodi­es they govern. The Nati­o­nal Offi­ce for the Judi­ciary and the Ministry of the Inte­ri­or joined the above ment­ion­ed anti-corruption fra­me­work in 2012 and 2014, respec­ti­vely. In 2016, on the fifth anni­ver­sary of its est­ab­lish­ment, the Pub­lic Pro­cu­re­ment Aut­ho­rity and the Nati­o­nal Bank of Hun­gary exp­res­sed their int­ent­ion to join the fra­me­work by sign­ing a memo­ran­dum of understanding.

On 17 Novem­ber 2016, five years after sign­ing the joint dec­la­ra­ti­on, Dr. Sán­dor Pin­tér, Minis­ter of the Inte­ri­or, Lász­ló Domo­kos, Pres­ident of the State Audit Offi­ce of Hun­gary, Dr. Tünde Handó, Pres­ident of the Nati­o­nal Offi­ce for the Judi­ciary, Dr. Péter Haj­nal, Head of Panel of the Curia and Dr. Ist­ván Laj­tár, Deputy Pro­se­cu­tor Gene­ral of Hun­gary held a mee­ting at the head­qu­ar­ters of the State Audit Offi­ce of Hun­gary to eva­lu­a­te the anti-corruption acti­vi­ti­es of the pub­lic ins­ti­tu­tions gover­ned by them, and com­mu­ni­ca­ted the results achi­eved to the public.

Acting on a pro­pos­al from the Ministry of the Inte­ri­or, the Govern­ment accep­ted a Nati­o­nal Anti-corruption Prog­ramme in 2015, which is vie­wed as the most impor­tant fra­me­work docu­ment of the government’s anti-corruption acti­vi­ti­es in the 2015-2018 peri­od. In har­mony with the spi­rit of the Joint Dec­la­ra­ti­on sign­ed five years ago, the Programme’s fun­da­men­tal objec­tive is to supp­ress cor­rupt­ion, and to imp­ro­ve Hungary’s com­pe­ti­ti­ve­ness and inter­na­ti­o­nal rep­uta­ti­on. This strategy prin­ci­pally sta­tes that every soci­etal phe­no­me­na where som­eo­ne abus­es the power ent­rus­ted to him/her for secu­ring any pri­vate or coll­ec­tive bene­fits is dang­erous for soci­ety as a whole. This strategic docu­ment does not strive to achi­eve the sha­red goals by using regu­la­to­ry inst­ru­ments only, the Programme’s prac­ti­cal imp­le­men­ta­ti­on is ensured by two-year long acti­on plans.

When the Prog­ramme was adop­ted, the Govern­ment reques­ted the Nati­o­nal Bank of Hun­gary and the Pub­lic Pro­cu­re­ment Aut­ho­rity to cont­ri­bu­te to the imp­le­men­ta­ti­on of anti-corruption tasks, and to give pri­ma­ry impor­tance to the pre­vent­ion of cor­rupt­ion while imp­le­ment­ing their respec­tive strate­gi­es. Con­se­qu­ently, the acces­si­on of the two orga­ni­sa­tions to the Joint Dec­la­ra­ti­on sho­uld not be vie­wed as the start of their cont­ri­bu­ti­on to anti-corruption eff­orts, but rat­her as a con­ti­nu­ed and deepe­ning acti­vity on their part.

In inte­gra­ted orga­ni­sa­tions, spe­ci­al attent­ion must be given to the human fac­tor, i.e. to posit­ions where emp­loye­es are inc­re­a­singly expo­s­ed to the threats of cor­rupt­ion. Amongst the anti-corruption acti­vi­ti­es of the Ministry of the Inte­ri­or, spe­ci­al ment­ion sho­uld be given to the work per­for­med by the Nati­o­nal Pro­tec­tive Ser­vi­ce est­ab­lis­hed five years ago. The expec­ta­ti­on set for the orga­ni­sa­ti­on was that it sho­uld break with the pre­vi­o­us law enfor­ce­ment image of its pre­de­ces­sor limi­ted exc­lu­si­vely to con­vent­io­nal sec­ret infor­ma­ti­on gat­he­ring, and sho­uld crea­te a rene­wed orga­ni­sa­ti­on res­pond­ing swiftly to soci­etal phe­no­me­na and mee­ting the actu­al needs of our times. Relia­bi­lity and impec­c­ab­le con­duct in life assess­ments as new legal inst­ru­ments have pro­ved succ­ess­ful. These assess­ments are alre­ady sho­wing a pre­ven­tive effect. The Nati­o­nal Pro­tec­tive Ser­vi­ce comp­le­ted a comp­lex cor­rupt­ion risk assess­ment pro­cess in rela­ti­on to job posit­ions fil­led by people wor­king at pub­lic admi­nistra­ti­on bodi­es, and these find­ings may also be used effec­ti­vely for the risk assess­ment and manag­ement of the affec­ted organisations.

The con­cept of the Act on the Gene­ral Rules of Pub­lic Admi­nistra­ti­on Pro­ce­e­dings also sets out the prin­cip­le that the pub­lic admi­nistra­ti­on sec­tor must preclu­de any form of cor­rupt­ion. If citi­zens have the pos­si­bi­lity to access electro­nic admi­nistra­ti­on or auto­ma­ted deci­si­on mak­ing in an inc­re­a­sing num­ber of admi­nistra­tive mat­ters, it will ensure effec­tive, uninf­lu­en­ced and law­ful pub­lic admi­nistra­ti­on pro­ce­e­dings. In this field, the sys­tem pro­vi­ding auto­ma­ted decision-making in the case of cert­ain traf­fic vio­la­tions, which has been imp­le­men­ted by the poli­ce for years, seems to be an examp­le to be followed.

The Ministry of the Inte­ri­or wel­co­mes the new orga­ni­sa­tions joi­ning the Joint Dec­la­ra­ti­on hop­ing that thro­ugh their com­mit­ment and deter­mi­na­ti­on they lend new momen­tum to the imp­le­men­ta­ti­on of the anti-corruption tasks.

The State Audit Offi­ce of Hun­gary (SAO), under a man­da­te from the Nati­o­nal Assemb­ly, com­mit­ted itself by buil­ding on the SAO Strategy to the imp­le­men­ta­ti­on of an inte­gra­ted pub­lic admi­nistra­ti­on cul­tu­re, and has paid spe­ci­al attent­ion to the fight aga­inst cor­rupt­ion for 10 years. In the past years, i.e. in 2007 and 2009, the Nati­o­nal Assemb­ly adop­ted seve­ral reso­lu­tions to man­da­te the State Audit Offi­ce of Hun­gary to strengt­hen its stance aga­inst cor­rupt­ion, and furt­her­mo­re, in its deci­si­on app­ro­ving the 2014 Annu­al Acti­vity Report of the SAO, it recogn­i­sed and con­fir­med the organisation’s acti­vi­ti­es rela­ted to the assess­ment of cor­rupt­ion risks and to the wides­pre­ad imp­le­men­ta­ti­on of integrity-based orga­ni­sa­ti­o­nal culture.

The State Audit Offi­ce of Hun­gary crea­ted a uni­qu­ely “Hun­ga­ri­an model” thro­ugh the Integ­rity Pro­ject devel­oped in coope­ra­ti­on with the Net­her­lands Court of Audit and laun­ched in 2009 by iden­ti­fying the rela­ted risks, wor­king out the rele­vant met­ho­do­logy and defi­ning the substan­tive ele­ments of integ­rity, mak­ing the model sui­tab­le for comp­re­hen­sive app­li­ca­ti­on thro­ug­ho­ut the enti­re Hun­ga­ri­an pub­lic finance sec­tor. In 2016, the SAO con­duc­ted its sixth integ­rity assess­ment on the cor­rupt­ion risks of the Hun­ga­ri­an pub­lic sec­tor. A record num­ber of bud­ge­tary aut­ho­ri­ti­es par­ti­ci­pa­ted in this year’s data coll­ec­ti­on pro­cess: a total of 3,002 orga­ni­sa­tions reg­is­te­red as res­pon­dents in the SAO-operated IT sys­tem. 400 more par­ti­ci­pants comp­le­ted the quest­ion­nai­res com­pa­red to the 2015 Integ­rity Assess­ment invol­ving 2,557 orga­ni­sa­tions, which up to that point had been cons­idered the largest-scale assess­ment. This year’s record num­ber of par­ti­ci­pants rep­re­sen­ted three times more res­pon­dents than the num­ber invol­ved in the first assess­ment car­ried out in 2011 (1,095 organisations).

Under the gui­dance of a rele­vant govern­ment deci­si­on, the State Audit Offi­ce of Hun­gary exten­ded its integ­rity assess­ment focus­ing on cor­rupt­ion risks and the level of pro­tec­ti­on to also inc­lu­de majo­rity state-owned com­pa­ni­es in Decem­ber 2015. 252 com­pa­ni­es sub­mit­ted properly comp­le­ted quest­ion­nai­res wit­hin the fra­me­work of the SAO’s first integ­rity assess­ment exten­ded to eco­no­mic ope­ra­tors. A sum­ma­ry analy­sis was pre­pa­red based on the ans­wers rece­i­ved, which was disc­los­ed by the State Audit Offi­ce of Hun­gary in con­junc­ti­on with a “good prac­ti­ces” semi­nar in May 2016. In Sep­tem­ber 2016, based on a pro­fes­si­o­nal con­sul­ta­ti­on with the Asso­ci­a­ti­on of Citi­es with County Rights, the SAO exten­ded its integ­rity assess­ment to local government-owned busi­ness asso­ci­a­tions, so it may soon have a clear­er pic­tu­re on the cor­rupt­ion risks of local government-owned com­pa­ni­es and on the sta­tus of the cont­rols devel­oped to mit­iga­te such risks.

The key achi­eve­ments of the past years, as well as of the rele­vant reso­lu­tions adop­ted by the Nati­o­nal Assemb­ly, are ref­lec­ted by the est­ab­lis­hed integ­rity cul­tu­re and the wides­pre­ad app­li­ca­ti­on of integrity-driven met­ho­do­logy. This is evi­den­ced by the gro­wing num­bers joi­ning the Circ­le of Integ­rity Sup­port­ers, so far almost two thou­sand orga­ni­sa­tions have under­ta­ken to par­ti­ci­pa­te annu­ally in the anti-corruption sur­vey of the State Audit Offi­ce of Hun­gary until to 2017, the­reby pro­vi­ding the pos­si­bi­lity for annu­al benc­h­mark­ing. The inc­re­a­singly wides­pre­ad use of integrity-driven met­ho­do­logy allows the State Audit Offi­ce of Hun­gary to place the emp­ha­sis on the deepe­ning and cont­roll­ing of integrity-related issues in the futu­re. To this end, from 2015 the assess­ment of integrity-based ope­ra­ti­on has been an ele­ment in every audit pro­ce­du­re, if per­mit­ted by law, as part of the fight aga­inst cor­rupt­ion.

As a dri­ving force behind the integrity-related chan­ge of atti­tu­de, the SAO has sup­port­ed pub­lic ins­ti­tu­tions in the imp­le­men­ta­ti­on the­reof by self-tests, as new inst­ru­ments, since 2014. The orga­ni­sa­tions comp­let­ing these volun­tary self-tests may imp­ro­ve their inter­nal cont­rol sys­tems and self-testing capa­bi­li­ti­es, in other words this met­hod may sup­port the pro­cess of lay­ing the foun­da­tions for orga­ni­sa­ti­o­nal integ­rity. We cons­ider it as impor­tant achi­eve­ment and as the uti­li­sa­ti­on of our acti­vity that the rele­vant prac­ti­ce pro­pa­ga­ted by the State Audit Offi­ce of Hun­gary was taken into account in Govern­ment Dec­ree No. 1104/2012 (IV.6.) on anti-corruption mea­sures and the adopt­ion of the Prog­ramme on Pre­vent­ing Cor­rupt­ion in Pub­lic Admi­nistra­ti­on and in Govern­ment Dec­ree No. 1336/2015 (V.27.) on the imp­le­men­ta­ti­on of the mea­sures set forth in the Nati­o­nal Anti-Corruption Prog­ramme, and these dec­re­es were focu­s­ed on the strengt­he­ning of pub­lic sec­tor integrity.

By its Reso­lu­ti­on No. 41/2013. (V. 27.), the Nati­o­nal Assemb­ly sup­port­ed the SAO in par­ti­ci­pat­ing in the Deve­lop­ment Ini­ti­a­tive (IDI) acti­vi­ti­es of the Inter­na­ti­o­nal Orga­ni­sa­ti­on of Sup­re­me Audit Ins­ti­tu­tions (INTOSAI), and for the SAO to pro­vi­de pro­fes­si­o­nal sup­port for this ini­ti­a­tive as donor, with spe­ci­al regard to Hun­ga­ri­an forei­gn trade strategy. At the end of 2015, the SAO sugg­es­ted that the Ministry for Nati­o­nal Eco­nomy of Hun­gary sho­uld ini­tia­te the real­lo­ca­ti­on of the SAO’s 2014 bud­get res­idue of HUF 129 mil­li­on to the sup­port fra­me­work manag­ed by the Ministry of Forei­gn Affa­irs and Trade fund­ing inter­na­ti­o­nal orga­ni­sa­tions. And then, the Govern­ment of Hun­gary, in line with the reso­lu­ti­on of the Nati­o­nal Assemb­ly adop­ted in 2013, adop­ted anot­her reso­lu­ti­on allo­wing that the above amount be offe­red for the pur­pos­es of the IDI donor prog­ram­mes, and with that step Hun­gary became a major fun­der of the IDI anti-corruption programmes.

The State Audit Offi­ce of Hun­gary is an active mem­ber of the inter­na­ti­o­nal com­mu­nity of nati­o­nal audit ins­ti­tu­tions, and con­ti­nu­ally sha­res and uti­li­ses the best prac­ti­ces learnt from them. The SAO’s semi­nar seri­es on inter­na­ti­o­nal “good prac­ti­ces” was laun­ched to this end, and wit­hin the fra­me­work of which in the spring of 2016 the State Audit Offi­ce of Hun­gary orga­ni­sed the now tra­di­ti­o­nal four-day inter­na­ti­o­nal semi­nar of “good prac­ti­ces” on integ­rity in Szar­vas for the third time, after 2014 and 2015, and it hopes to orga­ni­se the same event in 2017. During the three events orga­ni­sed so far, we sha­red our expe­ri­en­ces rela­ted to the fight aga­inst cor­rupt­ion with 90 audit experts dele­ga­ted by some 40 countries.

The deve­lop­ment of the integrity-based app­ro­ach in the pub­lic sec­tor and the nati­o­nal coope­ra­ti­on aga­inst cor­rupt­ion are well ref­lec­ted by the fact that the know­ledge and expe­ri­en­ces rela­ted to integ­rity manag­ement sys­tems have been/are inc­lu­ded in the edu­ca­ti­o­nal cur­ri­cu­lum of pub­lic ser­vi­ce pro­fes­si­o­nals and mana­gers. A uni­ver­sity cour­se for integ­rity advi­sors was laun­ched by the SAO with the coope­ra­ti­on of the Ministry of Pub­lic Admi­nistra­ti­on and Jus­ti­ce and the Nati­o­nal Uni­ver­sity of Pub­lic Ser­vi­ce in 2013, and 120 sub­ject mat­ter experts have gra­du­a­ted in the years pas­sed since. These integ­rity advi­sors sup­port the imp­ro­ve­ment of the pub­lic admi­nistra­ti­on sec­tor by redu­cing the risks of cor­rupt­ion and misu­se of power. The main pat­ron of the cour­se is the Pres­ident of the State Audit Offi­ce of Hun­gary. In its Reso­lu­ti­on No. 34/2015. (VII. 7.), the Nati­o­nal Assemb­ly, by recogn­is­ing the results achi­eved in this field, sup­port­ed that in respect of orga­ni­sa­tions invol­ved in the manag­ement of pub­lic funds and pub­lic property, the SAO sho­uld widen its con­sul­tancy acti­vi­ti­es regard­ing manag­ement sys­tems and sho­uld sup­port the train­ing of ethi­cal mana­gers in pub­lic finance.

The State Audit Offi­ce of Hun­gary sha­res the met­ho­do­logy and mea­sure­ment of the pre­vent­ion of cor­rupt­ion, as well as the results achi­eved, at dif­fe­rent pro­fes­si­o­nal, sci­en­ti­fic and edu­ca­ti­o­nal forums. Our goal is to offer our rese­arch and audit met­hods, based on strin­gent inter­na­ti­o­nal stan­dards, and the results the­reof as points of refe­ren­ce, so that these can cont­ri­bu­te to the pre­va­len­ce of integrity-based mentality.

The rep­re­s­en­ta­ti­ves of seve­ral state aut­ho­ri­ti­es held an annu­al dis­cus­si­on eva­luat­ing the results of the under­tak­ings lis­ted in the Joint Dec­la­ra­ti­on on Strengt­he­ning the Resis­tance aga­inst Cor­rupt­ion, which was sign­ed 18 Novem­ber 2011.

Last year, the Curia of Hun­gary again took nume­rous steps in order to imp­ro­ve integ­rity. Cons­ider­ing the fact that the term ‘integ­rity’ is not rest­ric­ted to the pre­vent­ion of the crime of cor­rupt­ion, but also inc­lu­des mea­sures taken in order to pre­vent any mate­ri­al loss or moral harm that could end­ang­er the state authority’s due func­tion­ing as pre­scri­bed by law, the Curia of Hun­gary gives top pri­o­rity to the regu­lar review of inter­nal rules and poli­ci­es. In 2016, the Ope­ra­ti­o­nal and Orga­ni­sa­ti­o­nal Rules were modi­fi­ed for seve­ral rea­sons. The depart­ment in char­ge of HR manag­ement and edu­ca­ti­o­nal affa­irs was trans­for­med into the Depart­ment for Coor­di­na­ti­on, HR Manag­ement and Edu­ca­ti­on and accord­ingly, the modi­fi­ed Orga­ni­sa­ti­o­nal Rules defi­ne all coor­di­na­ti­on tasks. In accor­dance with the law, the Ope­ra­ti­o­nal and Orga­ni­sa­ti­o­nal Rules est­ab­lish the posit­i­on and spe­ci­fy the dut­i­es of the Secu­rity Mana­ger of the Electro­nic Infor­ma­ti­on Sys­tem. Accord­ing to the amen­ded Orga­ni­sa­ti­o­nal Rules, the legal rep­re­s­en­ta­tive of the Curia shall be a judge ser­ving at the Curia. In addi­ti­on, the Orga­ni­sa­ti­o­nal Rules also spe­ci­fy judi­ci­al emp­loye­es’ obli­ga­tions pert­ain­ing to the dec­la­ra­ti­on of assets. In 2016, the President’s order on the for­mal requ­i­re­ments and draft­ing rules of the deci­sions of the Curia ente­red into force.

Last year, by way of its rep­re­s­en­ta­ti­ves the Curia was acti­vely invol­ved in the Integ­rity Task Force of the Nati­o­nal Offi­ce for the Judi­ciary (NOJ), which made sig­ni­fi­cant cont­ri­bu­tions to the Integ­rity Rules issu­ed by the Pres­ident of the NOJ. In accor­dance with its provi­sions, the Curia est­ab­lis­hed its own Integ­rity Rules which apply to both jud­ges and judi­ci­al emp­loye­es, and spe­ci­fy the rules relat­ing to the giving and accept­ance of pre­sents, the pro­hi­bit­ion of accept­ing cert­ain pre­sents, the dut­i­es of the Integ­rity Mana­ger, as well as the manag­ement of com­p­la­ints con­cer­ning integ­rity issues.

Over the cour­se of the past year, the Curia took furt­her mea­sures in order to imp­ro­ve the secu­rity of its IT sys­tem.  Based on the results of the vul­ne­ra­bi­lity tests, the ope­rat­ing sys­tems of cri­ti­cal ser­vers were rep­la­ced by new vers­ions sup­port­ed by the manu­fac­tu­rer. After attend­ing an e-learning cour­se in Eng­lish, the Secu­rity Mana­ger of the Electro­nic Infor­ma­ti­on Sys­tems pas­sed all exams succ­ess­fully and obta­ined the Cer­ti­fi­ed Infor­ma­ti­on Secu­rity Mana­ger (CISM) cer­ti­fi­ca­te, thro­ugh which he also comp­le­ted the com­pul­sory train­ing pre­scri­bed by law.

In addi­ti­on to infor­ma­ti­on secu­rity, the Curia also paid spe­ci­al attent­ion to the pro­tec­ti­on of clas­si­fi­ed data. Tak­ing into account that there is no tak­ing of evi­den­ce in ext­ra­or­di­nary remedy pro­ce­du­res, the Curia itself does not clas­si­fy, but rece­i­ves files con­tain­ing clas­si­fi­ed data from lower ins­tance courts, and ensures the pro­tec­ti­on of these data in line with pro­fes­si­o­nal and stat­uto­ry requ­i­re­ments. The pro­tec­ti­on of clas­si­fi­ed data in electro­nic form is ensured by a TEMPEST lap­top, which was obta­ined as a result of a ten­der anno­un­ced by the NOJ in 2016 and which is used by the Curia’s Clas­si­fi­ed Data Offi­ce. The tech­no­logy focus­es on min­imi­s­ing the electro­mag­ne­tic emana­tions of IT devi­ces con­tain­ing clas­si­fi­ed data, which can effec­ti­vely pre­vent any una­ut­ho­ri­sed access to these data. Pur­su­ant to app­lic­ab­le legal provi­sions, the Nati­o­nal Secu­rity Aut­ho­rity con­duc­ted the respec­tive qua­li­fi­ca­ti­on test, as a result of which the Curia obta­ined the ope­ra­ti­on permit.

In order to crea­te an orga­ni­sa­ti­o­nal envi­ron­ment that resists any form of cor­rupt­ion, last year the Curia orga­ni­sed knowledge-sharing con­fe­ren­ces for its emp­loye­es with the sup­port of the Cons­ti­tu­ti­on Pro­tec­ti­on Offi­ce, Hungary’s inter­nal secu­rity intel­li­gen­ce agency.

The con­fe­ren­ces focu­s­ed on strengt­he­ning secu­rity aware­ness and the pre­vent­ion of cor­rupt­ion. Coope­ra­ti­on is a key fac­tor in imp­ro­ving integ­rity, the­re­fo­re in 2016, the Curia par­ti­ci­pa­ted for the fifth time in an anti-corruption sur­vey con­duc­ted by the State Audit Offi­ce of Hun­gary as part of the Integ­rity Pro­ject and – toget­her with seven other ins­ti­tu­tions – was qua­li­fi­ed as ‘excel­lent’.

The Pres­ident of the Nati­o­nal Offi­ce for the Judi­ciary (NOJ) has vie­wed the deve­lop­ment of an orga­ni­sa­ti­o­nal and ope­ra­ti­o­nal sys­tem ensuring the integ­rity of courts as a pri­o­rity from the very beg­in­ning. The Pres­ident bears in mind the com­mit­ment under­ta­ken in the Joint Dec­la­ra­ti­on sign­ed in 2011 that emp­ha­si­sed the impor­tance of tak­ing effec­tive actions aga­inst cor­rupt­ion. Her com­mit­ment is furt­her ref­lec­ted by the fact that the integ­rity of the judi­ci­al struc­tu­re, the tran­spa­rency of the judi­ci­al and admi­nistra­tive prac­ti­ce, as well as the latter’s pre­dic­ta­bi­lity and cont­rol, have been inc­lu­ded amongst her strategic objec­ti­ves since 2012.

In 2012, the NOJ, in coope­ra­ti­on with the Cons­ti­tu­ti­on Pro­tec­ti­on Offi­ce, laun­ched a so-called Aware­ness Prog­ramme focus­ing on secu­rity aware­ness. The pro­fes­si­o­nals res­pon­sib­le for the train­ings pro­vi­de gra­phic demonstra­ti­on on secu­rity issues con­cer­ning the jud­ges and the judi­ci­al staff.

The Court Integ­rity Task Force of the NOJ has been also pur­su­ing its acti­vity since 2012. The mem­bers of this task force work at dif­fe­rent courts and in dif­fe­rent divi­sions as direc­tors, jud­ges and highly expe­ri­en­ced the­o­re­ti­cal and sub­ject mat­ter experts. They dis­cuss the most impor­tant integrity-related pro­fes­si­o­nal quest­ions, and work out the rela­ted admi­nistra­tive pro­po­s­ed mea­sures. In addi­ti­on, at first the Nati­o­nal Judi­ci­al Coun­cil was engag­ed as obser­ver, then from 2015 as a stand­ing mem­ber in the pro­fes­si­o­nal acti­vi­ti­es of the Euro­pe­an Net­works of Coun­cils for the Judi­ciary (ENCJ), where for­mal attent­ion is given to the Euro­pe­an norms of judi­ci­al inde­pen­den­ce and ethics.

The nati­o­nal courts con­ti­nue to be invol­ved every year in the integ­rity assess­ments con­duc­ted by the State Audit Offi­ce of Hun­gary.

The entry into force of the Code of Judi­ci­al Con­duct on 1 Janu­ary 2015 was a major step was in the pro­cess of enhanc­ing the integ­rity of the judi­ci­al sys­tem.  The Code sets ethics requ­i­re­ments for jud­ges based on the “Ban­ga­lo­re Prin­cip­les of Judi­ci­al Con­duct” by gro­u­ping such expec­ta­tions around the prin­cip­les of inde­pen­den­ce, impar­ti­a­lity, integ­rity, prop­ri­ety, equ­a­lity, com­pe­ten­ce and diligence.

In Novem­ber 2015, we sur­veyed the integ­rity sta­tus of the courts, and the aware­ness of the affec­ted jud­ges regard­ing the avo­ida­nce of situ­a­tions infring­ing and under­mi­ning integ­rity thro­ugh our integ­rity quest­ion­nai­res comp­le­ted by jud­ges. The draft Integ­rity Poli­cy was devel­oped by focus­ing on the most sen­sit­ive areas unco­ve­red by the find­ings of the questionnaire.

The Poli­cy on Court Admi­nistra­ti­on ente­red into force on 1 Janu­ary 2016, inten­ded to ensure the tran­spa­rency, pre­dic­ta­bi­lity and cont­rol of admi­nistra­tive work by regu­lat­ing admi­nistra­tive activities.

An Integ­rity Map of the Judi­ci­al Orga­ni­sa­ti­on was comp­le­ted in Janu­ary 2016, and in the same month an integ­rity con­fe­ren­ce was orga­ni­sed with the par­ti­ci­pa­ti­on of the aut­ho­ri­ti­es invol­ved in the coope­ra­ti­on acti­vi­ti­es. The atten­de­es heard pre­s­en­ta­tions on the integ­rity expos­ures of judi­ci­al acti­vi­ti­es, inc­lu­ding that of the courts, and on the poten­ti­al threats and the prac­ti­cal expe­ri­en­ces of manag­ing such situations.

The Integ­rity Poli­cy became effec­tive on 1 July 2016, and was aimed at ensuring and main­tain­ing the integ­rity of the judi­ci­al orga­ni­sa­ti­on, furt­her­mo­re at gua­ran­te­e­ing tran­spa­rency, res­pon­si­bi­lity, impar­ti­a­lity and pro­ce­dural fair­ness, as well as at gua­ran­te­e­ing uni­form and pro­por­ti­on­ate actions aga­inst any con­duct infring­ing integ­rity. One of the tan­gib­le results of the Poli­cy is that integ­rity mana­gers have been appoin­ted at the NOJ, at all the courts of appe­al and courts of jus­ti­ce and amongst others, these offi­cers are res­pon­sib­le for rece­i­ving, coll­ec­ting, analy­sing and eva­luat­ing the noti­fi­ca­tions relat­ing to the integ­rity of the judi­ci­al orga­ni­sa­ti­on, as well as for sup­port­ing the manag­ement deci­sions requ­i­red for tack­ling such issues.

The Integ­rity Quest­ion­naire for Jud­ges is plan­ned to be pub­lis­hed again befo­re the end of this year comp­le­men­ted with some addi­ti­o­nal quest­ions, and our aim is to sur­vey what results have been achi­eved by our eff­orts so far, and in what areas we need to take furt­her mea­sures. Furt­her­mo­re, the deve­lop­ment of a nati­o­nal scheme/template for assign­ing cases is under way.

The Hun­ga­ri­an Pro­se­cu­ti­on Ser­vi­ce achi­eved sig­ni­fi­cant results both in terms of the fight aga­inst cor­rupt­ion offen­ces and in the field of orga­ni­sa­ti­o­nal inte­gra­ti­on. Inter­nal and exter­nal coope­ra­ti­on is a fun­da­men­tal pre­re­qui­site for tak­ing effec­tive steps aga­inst corruption.

The Offi­ce of the Pro­se­cu­tor Gene­ral has sig­ni­fi­cantly enhan­ced its inter­na­ti­o­nal rela­ti­onsh­ips at vari­o­us levels. Spe­ci­al ment­ion sho­uld be given to the mutu­al legal assis­tance issues with the US, which are expec­ted to beco­me more stre­am­li­ned in the futu­re, as a result of mul­tip­le con­sul­ta­tions. The Offi­ce of the Pro­se­cu­tor Gene­ral has main­ta­ined an excel­lent rela­ti­onship with the Euro­pe­an Anti-fraud Offi­ce. The mee­ting bet­ween Pro­se­cu­tor Gene­ral Dr. Péter Polt and the Direc­tor Gene­ral of OLAF (Offi­ce Euro­pé­en de Lutte Anti-Fraude) Dr. Gio­van­ni Kess­ler held last year was fol­lo­wed by mul­tip­le con­sul­ta­tions and infor­ma­ti­on exc­hanges by the sub­ject mat­ter experts of the two organisations.

Owing to the effec­tive acti­vi­ti­es of the prosecutor’s offi­ce and the poli­ce, sup­port­ed by their respec­tive coun­ter­parts, a sig­ni­fi­cantly hig­her num­ber of cor­rupt­ion cases have been unco­ve­red in the past five years com­pa­red to pre­vi­o­us peri­ods (in total 2,818 cases were investiga­ted bet­ween 2006-2010, while 6,702 cases were tack­led bet­ween 2011-2015).

An Anti-corruption Depart­ment was set up by the Cent­ral Chief Pro­se­cu­ti­on Offi­ce of Investiga­ti­on in April 2011, which is res­pon­sib­le for investigat­ing corruption-related offen­ces com­mit­ted seri­ally or in an orga­ni­sed man­ner by govern­ment offi­ci­als fal­ling under the com­pe­ten­ce of the Cent­ral Chief Pro­se­cu­ti­on Offi­ce. In the past five years of the integration-related coope­ra­ti­on eff­ort (from Novem­ber 2011 to Sep­tem­ber 2016), the Cent­ral Chief Pro­se­cu­ti­on Offi­ce of Investiga­ti­on rece­i­ved 822 reports on cor­rupt­ion offen­ces, as a result of which 732 investiga­tions were laun­ched, and char­ges were pres­sed aga­inst 578 defen­dants in 201 cases. The courts have con­vic­ted 138 defen­dants in 86 cases so far. Nume­rous investiga­tions and court pro­ce­e­dings are still in prog­ress. The accu­se­es under pro­ce­e­dings inc­lu­ded per­sons pro­tec­ted by immu­nity, mayors, high rank­ing poli­ce offi­cers, tax aut­ho­rity and other officials.

The investiga­tions laun­ched by the Offi­ce of the Pro­se­cu­tor Gene­ral last year were all aimed at tak­ing more effec­tive steps aga­inst cor­rupt­ion, and at analy­sing the cha­rac­te­r­is­tics of the rela­ted offen­ces and the issue of con­fis­ca­ti­on of assets. The Offi­ce of the Pro­se­cu­tor Gene­ral sha­red its expe­ri­en­ces in the form of gui­dance with the Chief Prosecutor’s Offi­ces with a view to avo­i­ding the errors detec­ted in the future.

The new cent­ral depart­ment, i.e. the Depart­ment for Investigat­ing Spe­ci­al Anti-corruption and Orga­ni­sed Crime Cases, est­ab­lis­hed by the Offi­ce of the Pro­se­cu­tor Gene­ral as of 1 Janu­ary 2016 ensures more effec­tive tech­ni­cal manag­ement of the actions taken aga­inst cor­rupt­ion offences.

The Offi­ce of the Pro­se­cu­tor Gene­ral expla­ined its argu­ments during the codi­fi­ca­ti­on pro­ce­du­re of the new leg­i­sla­ti­on on cri­mi­nal pro­ce­e­dings, based on its expe­ri­en­ces gained from its fight aga­inst cor­rupt­ion. The prosecutor’s offi­ce agreed with the opin­ion that the plan­ned regu­la­ti­on would furt­her limit the scope of exempt­ions. It is an impor­tant achi­eve­ment that the draft leg­i­sla­ti­on con­ta­ins regu­la­tions on spe­ci­al investiga­tive tech­ni­ques, as a result of the con­sul­tancy pro­vi­ded by the prosecutor’s offi­ce. The use of vari­o­us con­ce­aled inst­ru­ments is ine­vi­tab­le in the detec­ti­on of and in pro­vi­ding evi­den­ce for cor­rupt­ion cases.

Any relia­bi­lity assess­ment per­for­med by the Nati­o­nal Pro­tec­tive Ser­vi­ce may only be con­duc­ted sub­ject to a prosecutor’s app­ro­val, and the pro­se­cu­tor also veri­fi­es the lega­lity of the investiga­ti­on after its comp­le­ti­on. These dut­i­es are per­for­med by the pub­lic law divi­si­on in the prosecutor’s orga­ni­sa­ti­on. The effec­ti­ve­ness of the scre­e­nings has imp­ro­ved this year, as des­pi­te the dec­re­a­sing num­ber of investiga­tions, the num­ber of integrity-related cases result­ing in cri­mi­nal char­ges has alre­ady rea­ched the ove­rall figu­res of the pre­vi­o­us year by Octo­ber (in 2015: 26 cases, up to Octo­ber 2016: 23 cases). Recently, the cri­mi­nal law divi­si­on of the Offi­ce of the Pro­se­cu­tor Gene­ral has also sum­ma­ri­sed the expe­ri­en­ces of cri­mi­nal pro­ce­e­dings laun­ched based on the relia­bi­lity assess­ments con­duc­ted. The key find­ing was the fol­lo­wing: no acqu­it­tal deci­sions have been adop­ted in any of these cases so far.

Per­so­nal and orga­ni­sa­ti­o­nal secu­rity is a fun­da­men­tal pre­re­qui­site for est­ab­lish­ing integ­rity. This issue car­ri­es spe­ci­al impor­tance in light of the machine-carbine attack car­ried out on the pre­mi­ses of the Regi­o­nal Court and Prosecutor’s Offi­ce of Kis­kun­ha­las in March 2016. Such new secu­rity risks jus­ti­fy the addi­ti­o­nal enhan­cement of pro­tec­ti­on. In April 2016, Pro­se­cu­tor Gene­ral Dr. Péter Polt and Minis­ter of the Inte­ri­or Sán­dor Pin­tér adop­ted a deci­si­on on a joint pro­se­cu­ti­on and poli­ce coope­ra­ti­on sche­me for the pur­pos­es of enhanc­ing the secu­rity and pro­tec­ti­on of the emp­loye­es, buil­dings and data assets of the prosecution’s offi­ces. Wit­hin the fra­me­work of this coope­ra­ti­on sche­me, a tech­ni­cal task force asses­sed the security-related ele­ments of the buil­dings used by the pro­se­cu­ti­on ser­vi­ce, and made a recom­men­da­ti­on on the est­ab­lish­ment of a nati­o­nal pro­se­cu­ti­on telep­ho­ne war­ning sys­tem. After comp­let­ing a succ­ess­ful test run in August 2016, the nati­o­nal telep­ho­ne sys­tem will start its ope­ra­ti­on from the first quar­ter of the com­ing year.

In addi­ti­on, orga­ni­sa­ti­o­nal integ­rity is strengt­he­ned by the assess­ment of cor­rupt­ion risks and by the con­ti­nu­al and large-scale train­ing just as much as the Pro­se­cu­tors’ Code of Con­duct adop­ted in Decem­ber 2014, as well as the pub­li­ca­ti­on of mea­sures taken in cor­rupt­ion cases on the organisation’s web­site and thro­ugh the media.
