Prosecutors
Prosecutors are authorised and ought to perform the prosecutorial activities and duties without any legal restrictions. In procedures against minors and in military criminal procedures only prosecutors can represent the Prosecution Service before the court, deputy prosecutors and trainee prosecutors are not allowed to do so.
To become a prosecutor one has to have a legal degree and need to pass the bar exam. They also have to work at least for a year either as a deputy prosecutor or as a court clerk, notary, attorney, legal counsel, researcher at the National Institute of Criminology, or as a detective at an investigative authority.
Prosecutors are appointed by the Prosecutor General after a successful application to a position posted by the Prosecution Service.
Prior to the appointment, an aptitude test must be taken, and the applicant needs to reach a good result, otherwise they won’t be appointed.
Once appointed, prosecutors can work either in or outside of the criminal law – field (the latter means they can work as a guardian of public interest or in the field of supervising the legality of the enforcement of punishments).
In 2019, 1,893 prosecutors were employed by the Prosecution Service of Hungary.

Deputy prosecutors
The activities and responsibilities of the deputy prosecutors are in line with the activities and responsibilities of the prosecutors. Deputy prosecutors work either in or outside the criminal law – field. However, they can represent the Prosecution Service only in trials at a local court level. They also cannot partake in trials against minors and in trials held in military criminal procedures.
To become a deputy prosecutor, after graduation one needs three years of training and a successful bar exam.
In 2019, 175 deputy prosecutors were employed by the Prosecution Service of Hungary.
Trainee prosecutors
Trainee prosecutors can draft decisions and measurements and can supervise investigation under the guidance of a prosecutor.
Trainee prosecutors can represent the Prosecution Service in trials at local court level, however, if the defendant is in custody, mentally impaired or the crime is severe, they cannot act before the court as representatives of the state.
Similarly, they cannot represent the Prosecution Service before the court in procedures against minors, in trials held in military criminal procedures and in pre-trial court sessions.
After graduating from law school, one can apply to a trainee prosecutor position if such position is announced by the Prosecution Service.
Trainee prosecutors are trained by practical and theoretical courses regularly.
In 2019, 70 trainee prosecutors were employed by the Prosecution Service of Hungary.
