Az Európai Parlament a 2015. október 14-én hozott határozatával felfüggesztette Kovács Béla, az Európai Parlament képviselője mentelmi jogát. Az erről szóló hivatalos értesítés megérkezett a Legfőbb Ügyészségre.
A részletesen indokolt határozatot az Európai Parlamentben úgy fogadták el, hogy előtte az Európai Parlament Jogi Bizottsága gondosan megvizsgálta az ügyet. Ennek keretében a Jogi Bizottság dr. Polt Péter legfőbb ügyésztől kiegészítő információkat kért, valamint 2015. július 14-én személyesen is konzultált a magyar legfőbb ügyésszel.
Az Európai Parlament 2015. október 14-ei határozata kimondta, hogy Magyarország Alaptörvényének megfelelően a legfőbb ügyész és az ügyészség függetlenek, alkotmányos feladataikat külső szervektől függetlenül végzik, és az ártatlanság vélelmét tiszteletben tartva járnak el.
Az Európai Parlament határozata rámutatott arra, hogy nem találta semmi jelét annak, hogy a mentelmi jog felfüggesztését a képviselővel szemben politikai kár okozása céljából indított eljárással összefüggésben kérték volna.
Az Európai Parlament Jogi Bizottsága a fentieknek megfelelően 14 igen, 2 nem és 2 tartózkodás mellett hozta meg a határozati javaslatát, amelyet az Európai Parlament 2015. október 14-ei ülésén nyílt szavazással fogadtak el.
A Legfőbb Ügyészség az Európai Parlament mentelmi jog felfüggesztéséről hozott határozatát – a további szükséges intézkedések végett – a Központi Nyomozó Főügyészségnek küldi meg.
Az ügy előzménye, hogy dr. Polt Péter legfőbb ügyész – a Központi Nyomozó Főügyészség addig lefolytatott nyomozása eredményéhez képest – 2014. május 12-én diplomáciai úton Martin Schulzhoz, az Európai Parlament elnökéhez fordult, indítványozva, hogy az Európai Parlament függessze fel Kovács Béla, az Európai Parlament képviselője mentelmi jogát.

With its Decision of 14 October 2015 the European Parliament waived the right of immunity of Béla Kovács, Member of the European Parliament (MEP). The Office of the Prosecutor General of Hungary has received official notification thereof.
The Decision, justified with a detailed explanatory statement, was adopted by the European Parliament after the European Parliament Committee on Legal Affairs had carefully examined the case. As part of the examination the Committee on Legal Affairs requested dr. Péter Polt, Prosecutor General of Hungary to provide additional information, and on 14 July 2015 the Prosecutor General was also consulted in person, too.
Decision of 14 October 2015 of the European Parliament stated that under the Fundamental Law of Hungary, the Prosecutor-General and the Prosecution Service are independent, carry out their constitutional tasks independently from external organisations, and proceed in compliance with the presumption of innocence.
The Decision pointed out that the European Parliament had found no evidence that the request for waiver of immunity had been made in connection with proceedings brought with the intention of causing political damage to the Member concerned.
In accordance with the above, the European Parliament Committee on Legal Affairs adopted its proposed decision by 14 votes to, 2 votes against and with 2 abstentions. The Decision was adopted by open voting at the European Parliament’s session of 14 October 2015.
The Office of the Prosecutor General will send the European Parliament Decision on the request for waiver of the immunity of Béla Kovács to the Central Chief Prosecution Office of Investigation to take further measures.
The antecedent of the case was that based on results of the criminal investigations having been conducted up to that point by the Central Chief Prosecution Office of Investigation, dr. Péter Polt, Prosecutor General of Hungary contacted Martin Schultz, President of the European Parliament through diplomatic channels on 12 May 2014, requesting that the immunity of Béla Kovács, MEP be waived.
